Problems of Circulation and Use of Digital Currency

Capital lawyers and business people discussed the issues of circulation and use of digital currency at a round table. The event was held at the Moscow Regional Branch of “Business Russia” and its main theme was the circulation and use of digital currency, including the context of protecting the rights of digital financial asset (DFA) market participants. The event was organized by Sergey Gaevsky, a member of the board of the Moscow Regional Branch of “Business Russia” and managing partner of the law firm “Gaevsky and Partners”.

Leading Russian experts in the field of digital assets and cryptocurrency took part in the discussion:

  • Oleg Ushakov: Founder of the law firm Sagrada Legal, Chairman of the DFA Commission of the Russian Chamber of Commerce and Industry
  • Alena Narinyani: CEO of the marketing agency “Crypto-A”, journalist, entrepreneur, expert in cryptocurrencies and blockchain technology
  • Maria Agranovskaya: Lawyer of the Moscow Region Bar Association, Partner at “Granovskaya and Partners”, member of the Moscow Bar Association “GRAD”, LLC “DFA Center”, member of the BRICS Business Council, expert of the RSPP Committee on Payments, and others
  • Vadim Konyushkevich: Managing partner of the law firm “VK Partners”, lawyer, lecturer at the National Research University “Higher School of Economics” (Moscow)
  • Ekaterina Ledokol: Founder of the Global Vision Summit, member of the Moscow Regional Branch of “Business Russia”
  • Georgy Lyamin: Expert in the field of crypto asset search, assistant lawyer at “Gaevsky and Partners”
  • Alexey Artamonov: Leading expert on financial issues and analytics at the Center for Business Rehabilitation (CBR) at the Moscow Regional Branch of “Business Russia”

The event was moderated by Evgeny Puchkarev, a lawyer at the Krasnoyarsk Bar Association, leading legal expert at the Center for Business Rehabilitation (CBR) at the Moscow Regional Branch of “Business Russia”.

In an open dialogue format, a number of fundamental issues were addressed, answers to which (including from relevant government departments) should determine the further development of the DFA and cryptocurrency sector in Russia. How is the legal regulation of digital currency currently being carried out in the Russian Federation and CIS countries? What could change in this aspect tomorrow? What should be expected from the legal framework for cryptocurrency in cross-border circulation? What are the latest trends and new tools? What is the current focus of the BRICS Business Council? Are the upcoming changes in the field of digital currency, mining, and the introduction of legal frameworks more beneficial or more harmful? Are there currently effective ways to identify cryptocurrency wallets? What is the global practice in this area?

The event also covered trends in judicial practice: cases involving digital assets (rights to digital assets and inclusion in the bankruptcy estate), criminal cases (theft/embezzlement/illegal circulation of cryptocurrency and issues of establishing rights to cryptocurrency wallets), civil and arbitration processes.
